By accessing or using ChromaSpec ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

ChromaSpec provides AI-powered vehicle wrap visualization services that allow users to upload vehicle images and generate photorealistic previews of various wrap colors and finishes. The Service includes inventory management, customer management, proposal generation, and related business tools for professional wrap shops.

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Providing accurate, current, and complete information during registration

4. Acceptable Use

You agree not to use the Service to:

  • Upload content that infringes on intellectual property rights
  • Upload illegal, harmful, or offensive content
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any illegal or unauthorized purpose
  • Reverse engineer, decompile, or disassemble the Service

5. Content Ownership

Your Content: You retain ownership of all images and content you upload to the Service. By uploading content, you grant ChromaSpec a non-exclusive, worldwide, royalty-free license to use, process, and store your content solely for the purpose of providing the Service.

Our Content: The Service and its original content (excluding user-provided content), features, and functionality are and will remain the exclusive property of ChromaSpec and its licensors.

6. Subscription and Payments

Some features of the Service require a paid subscription. By subscribing, you agree to:

  • Pay all applicable fees as described in the selected subscription plan
  • Provide valid payment information
  • Authorize recurring charges on a monthly or annual basis

Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or by contacting support.

7. Render Credits and Usage Limits

Each subscription tier includes a specific number of AI render credits per billing period. Unused credits do not roll over to subsequent periods. Usage beyond included credits may result in additional charges or temporary service limitations until the next billing period.

8. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Service with or without notice.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI-GENERATED VISUALIZATIONS ARE APPROXIMATIONS AND MAY NOT EXACTLY REPRESENT FINAL WRAP RESULTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHROMASPEC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless ChromaSpec, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may request export of your data within 30 days of termination.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
